Rainwater Collection and RechargeCEBU, Philippines – The Cebu provincial government has set to establish a rain water catchment facility in Malapascua Island in the Municipality of Daanbantayan to encourage water conservation at the popular tourist destination.

The Provincial Board has passed the resolution sponsored by Board Member Thadeo Jovito Ouano, chairman of the PB committee on environment, authorizing Governor Hilario Davide III to enter into a memorandum of agreement with the municipality through Mayor Vicente Loot.

The Provincial Legal Office has reviewed the draft agreement and found it to be valid in form and substance and the terms thereof are not contrary to law, established rules and regulations.

Lawyer Jennifer Maniwang recommended, however, to revise the agreement to add the necessary provisions to emphasize the compliance with auditing and Commission on Audit rules so that the interest of the province can be protected better.

“We propose to add a provision to indicate that the downloaded funds shall be used solely for the purpose for which they were granted,” Maniwang said.


Another recommendation was to include the provisions on the submission of reports of disbursement and liquidation of the funds and that Daanbantayan will faithfully comply with the existing accounting and auditing rules and usual COA rules and relevant laws.

The draft MOA also provides that as far as necessary and or possible, Daanbantayan shall provide adequate financial counterpart for the implementation and maintenance costs for the project.

rainwater catchmentFollowing legal opinion dated October 10, 2016 duly approved by Provincial Legal Officer Orvi Ortega, Baltazar Tibunalo, the officer-in-charge of the Provincial Environment and Natural Resources Office, endorsed on October 12, 2016 to the PB for the authority of the Governor.

On December 14, 2015, the PB passed a resolution sponsored by Board Member Christopher Baricuatro authorizing Davide to grant and release the financial assistance amounting to P152,251.95 to the municipality for the supply of labor, materials and incidentals for the construction of said RWCF in Malapascua Island to be implemented by the municipality.

This is in compliance with Republic Act No. 6716, otherwise known as the Rainwater and Spring Development Act of 1989, which promotes Rain Water Catchment Facility (RWCF) as a mechanism to promote water conservation and control flooding.

The law further provides that the state shall utilize an environmentally-sound method that maximizes the utilization of valuable resources and encourages water conservation.

The RWCF is useful both during the wet and dry seasons, by minimizing the impact of floods, and serving as additional water resource during summer.

The construction of the RWCF is one of the priority infrastructure interventions of the Cebu Province.
